Comprehensive Participation Waiver & Release of Liability

Including Waterloo Pickleball & Urban Pickleball – Barton

In consideration of being allowed to participate in any way in programs, events, or activities (the “Activities”) organized by or involving Capital City Pickleball LLC, Waterloo Pickleball, Urban Pickleball – Barton, and their affiliates, owners, officers, directors, employees, contractors, event hosts, representatives, volunteers, and sponsors (collectively, the “Released Parties”), I, the undersigned, acknowledge, understand, and agree to the following:

1. Acknowledgment and Assumption of Risks

I understand that pickleball, athletic training, recreational games, physical activities, and related movement inherently involve significant risks and potential for injury, both known and unknown. These risks include, but are not limited to:

Slips, trips, collisions, and falls

Being hit by a ball or paddle

Sprains, strains, dislocations, fractures

Concussions, head and spinal injuries

Heat exhaustion, dehydration, or overexertion

Property damage or theft

Severe injury, paralysis, or death

I acknowledge that these risks may result from my own actions or inactions, those of others participating, or the condition of the premises, equipment, and facilities.

I expressly and voluntarily assume all risks, both known and unknown, including those that may arise out of the negligence of the Released Parties or others, and take full responsibility for my participation.

2. Release and Waiver of Liability

I, for myself and on behalf of my heirs, executors, administrators, assigns, personal representatives, and next of kin, hereby voluntarily waive, release, discharge, and hold harmless the Released Parties from and against any and all claims, demands, suits, damages, losses, causes of action, liabilities, or expenses (including legal fees) of any kind, arising directly or indirectly from my participation in the Activities.

This waiver includes, without limitation, any claims arising from:

Negligence or carelessness by the Released Parties

Premises liability

Use or misuse of facilities, equipment, or playing areas

Actions or inactions of other participants or spectators

3. Medical Fitness and Emergency Treatment

I certify that I am in good physical health and able to safely participate in the Activities. I have not been advised otherwise by a qualified medical professional. I do not have any condition that would increase the likelihood of injury or illness during the Activities.

I consent to receive medical treatment deemed advisable by event staff or emergency responders in the event of injury, accident, or illness, and agree to be responsible for any associated costs.

I release and hold harmless the Released Parties from any claim arising out of such treatment or lack thereof.

4. Conduct, Supervision, and Facility Rules

I agree to follow all rules and guidelines established by the facilities and the Released Parties during any event, including but not limited to:

No outside coaching (drilling permitted)

No unauthorized use of courts or facilities

Supervision required for minors under age 14

No aggressive or disruptive behavior

No unauthorized alcohol or substance use

Guests must sign a waiver and comply with rules

Failure to follow rules may result in removal from an event or revocation of membership or access privileges without refund.

I accept full responsibility for any damage I cause to facilities, equipment, or property.

5. Minors & Legal Guardianship

If I am registering or bringing a participant under the age of 18 (a “Minor”), I certify that I am the Minor’s parent or legal guardian and have the legal authority to bind them to this Agreement. I accept all responsibilities and liabilities for the Minor’s participation and agree to supervise them at all times unless explicitly permitted otherwise by the organizers.

6. Media Release

I grant the Released Parties the irrevocable right and permission to use my name, likeness, voice, image, and/or appearance as captured in any photograph, video, audio recording, or other media during any Activities for promotional, educational, or commercial purposes in any format or media (digital, print, broadcast, etc.), without compensation or notification.

7. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, suits, damages, losses, liabilities, judgments, and expenses (including attorneys’ fees) arising out of or related to my participation in the Activities or any violation of this Agreement.

8. Sponsors, Vendors, and Partners

I understand that events may include third-party sponsors, vendors, or partners, and that their involvement does not create liability on their part for any injury or claim arising from the Activities. I release all such parties from liability, claims, or obligations relating to my participation.

9. Lost, Stolen, or Damaged Property

I acknowledge that the Released Parties are not responsible for any personal property that is lost, stolen, or damaged while I am participating in any Activities or present at the facilities.

10. Communicable Diseases / COVID-19 Risk

I understand and acknowledge that there are inherent risks of exposure to communicable diseases, including COVID-19, during any public or group activity. I voluntarily assume all risks related to such exposure, illness, or transmission and waive any claims against the Released Parties for associated damages or harm.

11. Governing Law and Venue

This Agreement is governed by the laws of the State of Texas. Any legal action or proceeding arising out of this Agreement shall be brought exclusively in the courts of Travis County, Texas, and I consent to jurisdiction therein.

12. Severability

If any provision or part of this Agreement is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

13. Entire Agreement and Acknowledgment

This Agreement represents the entire understanding between the parties with respect to the subject matter herein and supersedes all prior written or oral representations. I certify that I have read this document in its entirety, understand its contents, and sign it voluntarily with full knowledge of its significance.
