RIVERLAND COMMUNITY ASSOCIATION, INC. RECREATIONAL AMENITIES RELEASE AND WAIVER

I, the below named Participant or Participant registering for this event, hereby execute this Riverland Community Association, Inc. Recreational Amenities Release and Waiver (“Release”) in connection with my: (a) use of the Riverland recreation amenities and facilities including, without limitation: recreation trails, sports and racquet club complex, the wellness and fitness center, the paseo and all other pathways, fitness center and studio, indoor sports courts, tennis courts, pickleball courts, pro shop, bocce courts, pools, spas, massage rooms, saunas, steam rooms, hydrotherapy rooms, cafe, arts and culture center complex, community gardens, assessed rooms, art studios, demonstration kitchens, event plaza, and/or any portion of any of the recreation amenities and facilities, and/or the equipment and facilities located therein and therein (each referred to herein individually as a “Recreation Amenity” and collectively as the “Recreation Amenities”) which are owned, operated or maintained by Riverland Community Association, Inc. (the “Association”), (b) participation in any and all activities sponsored, promoted or set up by the Association and whether or not such activities take place on the Association Property or elsewhere (the “Activities”), and/or (c) use of any website and/or software application provided by or through the Association and/or the Association’s vendors, including, without limitation, any such website and/or software application related to Riverland, the Recreation Amenities and/or the Activities (the “Apps”). I acknowledge, fully understand and hereby agree as follows: 1. I am responsible for my own safety while using any of the Recreation Amenities and/or Apps and/or while participating in the Activities and I will therefore fully familiarize myself with the safe use of the applicable Recreation Amenities, Apps and Activities. It is my responsibility to ensure that my family members, tenants, guests, and invitees understand that they are responsible for: (a) their own safety while using any of the Recreation Amenities and/or Apps and/or participating in the Activities, and (b) fully familiarizing themselves with the safe use of and/or participation in the applicable Recreation Amenities, Apps and/or Activities. 2. Physical exercise can be strenuous and subject to risk of serious injury and/or death, and that I should seek the advice of a physician before beginning use of the Recreation Amenities and/or participating in any Activities. I will only use the Recreation Amenities and/or participate in the Activities when I am physically able to do so. 3. My use of the Recreation Amenities and/or Apps and/or participation in Activities bears both known and unknown risks that could result in injury, damage to property and illness, disease, emotional distress, damage or loss to me and/or my property as well as to third parties and/or their property. I acknowledge and agree that I am solely responsible for the selection of any Recreation Amenities and/or Apps, fitness activities, sports, classes, programs and instruction and the use of the Recreation Amenities and/or Recreation Amenities. I know that the known and unknown risks may include, but are not limited to, physical injury, illness, contraction of ailment of any kind (known or unknown), serious personal injury, permanent disability, death, illness, disease, emotional distress, damage or loss to me and/or my property. I acknowledge that injury might result from my use of the Recreation Amenities and/or Apps and/or participation in Activities. I hereby assume full responsibility and obligation to ensure that my family members, tenants, guests and invitees also assume and accept all of the known and unknown risks that might result from their use of the Recreation Amenities and/or Apps and/or participation in Activities. This Release shall be deemed their agreement to assume all of the known and unknown risks, dangers, and hazards in connection with the Activities. 4. I, for myself, my family, my heirs, my tenants, guests or invitees, my executors, administrators, successors, permitted assigns hereby voluntarily release, waive, relinquish, surrender and forever discharge the Association and Riverland Development Company, LLC (the “Declarant”) and their members, managers, officers, employees, partners, vendors, servicers, contractors, subcontractors, agents, and assigns (collectively, the “Released Parties”) from any and all actions, causes of action, suits, damages, claims, and demands whatsoever of any kind or nature, including without limitation, all claims based on any action or inaction of any of the Released Parties in connection with the Recreation Amenities and/or the Activities. I understand that this Release includes any claims based on any action or inaction (negligent, reckless or otherwise) of the Released Parties. 5. I hereby indemnify and hold the Released Parties harmless from and against any and all losses incurred by my family members, guests, and/or invitees, including without limitation my (including their) members arising out of and/or in any way connected with their uses of the Recreation Amenities and/or participation in Activities and/or related to any claims arising based on any action or inaction of the Released Parties. I understand and agree that any instruction offered or sold by any of the Released Parties or in connection with the Recreation Amenities and/or Activities. I understand that indemnify and hold harmless includes any claims based on any action or inaction (negligent, reckless or otherwise) of the Released Parties or any other person. 6. Should any of the Released Parties incur reasonable attorney’s fees, costs or other expenses to enforce this Release, whether or not any proceeding is initiated, I agree to indemnify and reimburse the Released Parties all such fees, costs and expenses incurred by the Released Parties up to and through all trial, appellate and post-judgment proceedings. 7. This Release and any disputes arising under or related to it shall be governed and interpreted pursuant to the laws of the State of Florida, without regard to its conflict of laws rules. I acknowledge that the Recreation Amenities and Activities are located in St. Lucie County, Florida. I KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT I MAY HAVE TO A TRIAL BY JURY IN ANY ACTION, SUIT OR PROCEEDING BROUGHT TO ENFORCE, DEFEND OR INTERPRET ANY RIGHTS OR REMEDIES UNDER, ARISING IN CONNECTION WITH AND/OR RELATING TO THIS RELEASE, INCLUDING, BUT NOT LIMITED TO, ANY ACTION OR PROCEEDING ARISING IN CONNECTION WITH AND/OR RELATING TO MY USE OF THE RECREATION AMENITIES AND/OR APPS AND/OR PARTICIPATION IN THE ACTIVITIES. THIS MEANS THAT A JUDGE AND NOT A JURY WILL BE THE TRIER OF FACT IN RESOLVING ANY ACTION, SUIT OR PROCEEDING REGARDLESS OF (A) IF THE NATURE OF THE ACTION, SUIT AND/OR PROCEEDING, (B) WHETHER THE ACTION, SUIT AND/OR PROCEEDING IS BASED IN CONTRACT, TORT, NEGLIGENCE, STATUTE OR OTHERWISE, AND/OR (C) THE NATURE OF THE INJURY ALLEGED (INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND/OR THE ECONOMIC OR NON-ECONOMIC DAMAGES. 8. This Release is intended to be as broad as is permissible under the laws of the State of Florida. If any provision of this Release shall be found to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from this Release and shall not affect the validity and enforceability of the remaining provisions. The Released Parties acknowledge the Association, the Declarant and/or any of the Released Parties would not seek to enforce each and every provision of this Release. I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND AND AGREE TO ITS TERMS. I FURTHER UNDERSTAND AND AGREE THAT I AM GIVING UP SUBSTANTIAL RIGHTS. I FURTHER UNDERSTAND THAT THIS IS A RELEASE OF LIABILITY WHICH PRECLUDES PURSUING ANY CLAIMS AGAINST THE RELEASED PARTIES FOR DAMAGES, INJURY AND/OR OTHER DAMAGE IN RELATION TO USE OF THE RECREATION AMENITIES AND/OR PARTICIPATION IN THE ACTIVITIES. I HAVE SIGNED THIS RELEASE FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND THIS RELEASE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. __________________________ __________________________ __________________________
